1. Acceptance of Terms

Welcome to PlantBuddy AI ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the PlantBuddy AI mobile application (the "App") and all related services (collectively, the "Services"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms.

2. Description of Service

PlantBuddy AI is a mobile application that provides AI-powered plant identification, care recommendations, garden management tools, and community features to help users grow and maintain healthy plants and gardens.

2.1 Features

• Plant identification and health analysis using AI technology
• Personalized care recommendations and reminders
• Garden management and tracking tools
• Community features for sharing and learning
• Weather-based care suggestions
• Premium subscription services (Garden Pro)

3. Eligibility and Account

3.1 Age Requirement

You must be at least 13 years of age to use the App. If you are under 18, you confirm that you have obtained parental or guardian consent to use the App.

3.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring the accuracy of information you provide
• Notifying us immediately of any unauthorized access

4. Subscription Services

4.1 Garden Pro Subscription

Certain features of the App are available through a paid subscription service ("Garden Pro"). Subscription details including pricing, duration, and features are displayed in the App.

4.2 Auto-Renewal

• Monthly Subscription: Automatically renews each month at the applicable monthly rate
• Annual Subscription: Automatically renews each year at the applicable annual rate

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

4.3 Payment and Pricing

• Payment is charged to your iTunes Account at purchase confirmation
• Subscription renewals are charged within 24 hours prior to the end of the current period
• We reserve the right to change subscription prices with 30 days' advance notice
• Current users will maintain their current pricing until their subscription period ends

4.4 Cancellation

• You may cancel your subscription at any time through your iTunes Account Settings
• Cancellation takes effect at the end of the current billing period
• You will continue to have access to premium features until the end of your current billing period
• No refunds are provided for partial subscription periods

4.5 Free Trials

If offered, free trial periods will automatically convert to a paid subscription unless canceled before the trial ends. You can cancel anytime during the trial period without charge.

5. User Content and Conduct

5.1 User-Generated Content

You retain ownership of all content you upload, post, or share through the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content in connection with the Services.

5.2 Acceptable Use

You agree NOT to:

• Upload, post, or transmit any content that is illegal, harmful, or offensive
• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm other users
• Spam or send unsolicited messages
• Attempt to gain unauthorized access to the App or its systems
• Reverse engineer or attempt to extract source code
• Use the App for commercial purposes without authorization

5.3 Content Moderation

We reserve the right to monitor, review, modify, or remove any User Content that violates these Terms or is otherwise objectionable, with or without notice.

6. Intellectual Property

6.1 Our Rights

The App and all related content, features, and functionality (including but not limited to text, graphics, logos, images, software, and code) are owned by True Solutions LLC and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the App for personal, non-commercial purposes.

6.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Redistribute, sublicense, or sell the App
• Remove or alter any proprietary notices
• Use our trademarks, logos, or branding without permission

7. Disclaimers and Limitations

7.1 Service Availability

The App is provided "as is" and "as available." We do not guarantee that the App will be uninterrupted, error-free, or available at all times. We reserve the right to modify, suspend, or discontinue the App at any time.

7.2 AI Recommendations

While we strive for accuracy, AI-powered features including plant identification and care recommendations are provided for informational purposes only. We do not guarantee the accuracy, completeness, or suitability of any recommendations or information provided.

7.3 No Warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.4 Limitation of Liability

To the fullest extent permitted by law, in no event shall True Solutions LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the App.

8. Indemnification

You agree to indemnify and hold harmless True Solutions LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any rights of another party.

9. Termination

9.1 Termination by You

You may stop using the App at any time by deleting it from your device. Canceling your subscription does not automatically delete your account or data.

9.2 Termination by Us

We may terminate or suspend your access to the App immediately, without notice, for any reason, including but not limited to violation of these Terms.

9.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. We may delete your account and data in accordance with our Privacy Policy.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

10.2 Arbitration

Any disputes arising from or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
